1. OBJECT
The purpose of these rules is to regulate the granting of a free advisory and support service in the constitution of commercial companies. This program is aimed at all commercial companies that will be domiciled in the municipality of Malaga, as a way of supporting the start and implementation of business activity.
2. REQUIREMENTS
Commercial companies that meet the following requirements may be beneficiaries of this service:
- That the corporate and tax domicile of the company will be in Malaga capital.
- The main activity will be carried out in Málaga Capital.
- That the applicant has a valid negative certificate of company name.
- That the applicant does not incur any of the prohibitions provided for in article 13 of Law 38/2003 General Subsidies.
3. HOW TO APPLY
In-person procedure:
- Fill in the form: https://www.promalaga.es/malaga-emprende/solicitud-de-visita/ . A technician will contact the user to explain the documentation that he must provide and how to obtain it.
- Send the necessary documentation by e-mail and request an appointment to come and sign the application and annexes.
- Go to the Málaga Emprende office of Promálaga in C/ Álamos, 34, Malaga.
- Once the complete programme documentation has been reviewed and assessed, it will be stamped and signed by a Promálaga technician and you will be given the contact details of the consultancy.
- Obtain a registered copy of your presentation.
- An appointment will be made with the consultancy.
- In the event that the documentation submitted is incomplete, you will be required to correct it.
3. SERVICES INCLUDED IN THE PROGRAMME FOR THE INCORPORATION OF COMPANIES
Prior advice to determine the legal form, the application for the company name, the preparation of the articles of association, accompaniment to the notary’s office to sign the deed of incorporation, the processing of the liquidation of the Transfer Tax and Documented Legal Acts, the processing for Registration in the corresponding Registers and the obtaining of the definitive CIF (Tax ID number).
Notary and Commercial Registry fees are not included.
The company must formalize the articles of incorporation within a maximum period of one month from the date of the granting of the service, otherwise, provision of the service will be withdrawn.
Telematic procedure:
- Start the process by sending to malagaemprende@promalaga.es the application and annexes completed and digitally signed, attaching the scanned documentation. If a digital certificate is not available, the forms will be completed and signed in person, for which an appointment must be made at 952 24 34 11.
- Once the program documentation has been reviewed and evaluated by a Promálaga technician:
- If the documentation is incomplete, we will contact the applicant to ask for it to be corrected.
- If the documentation is correct, a Promálaga technician will contact the applicant to send them their free advice application validated by Promálaga, as well as the contact details of the assigned consultancy so that the service can begin.

4. DOCUMENTATION TO BE SUBMITTED
- Application form.
- Photocopy of the D.N.I/ N.I.E of the entrepreneur/s setting up the new company.
- Negative certificate of the name in force.
- Annex 1: Declaration of responsibility.
- Annex 2: Consent for communications between Promálaga and the responsible consultancy.
5. DETAILS OF THE CONSULTANCY SERVICES
Services included in the company formation program:
