Free advice for new businesses

1. OBJECT

The purpose of these rules is to regulate the granting of an advisory service to newly created companies in Malaga during their first year of activity which is completely free of charge for them.

This service includes one year of tax, labour and accounting advice from the first visit to the assigned advisor, within the limits established in Appendix 4, at no cost to the beneficiary.

This programme is aimed at all commercial and civil companies and individual entrepreneurs, who will be domiciled in the municipality of Malaga, as a way of supporting the start-up and implementation of business activity.

2. REQUIREMENTS

  • 1. The business must be newly created, whether a natural person or a legal entity, as long as it is not registered in the IAE at the date of application., both as a natural person or legal person.
  • 2. The registered offices must be in the city of Malaga.
  • 3. The main activity must be carried out in the city of Malaga.
  • 4. At least one job must be created with an indefinite contract for a previously unemployed person. The employment to be created can be either the individual entrepreneur, working partners or new employment contracts with a minimum of 20 hours per week. An employee in active employment who is going to start his or her activity as an individual entrepreneur or working partner may also be a beneficiary, as long as he or she is in a situation of improved employment..
  • 5. The applicant must not meet any of the prohibitions foreseen in article 13 of the General Law 38/2003 on subsidies.

3. HOW TO APPLY

In-person procedure:

  1. Fill in the form: https://www.promalaga.es/malaga-emprende/solicitud-de-visita/ . A technician will contact the user to explain the documentation to be provided and how to obtain it.
  2. Send the necessary documentation by e-mail and request an appointment to come and sign the application and annexes.
  3. Go to the Málaga Emprende office of Promálaga in C/ Álamos, 34, Malaga.
  4. Once the complete programme documentation has been reviewed and assessed, it will be stamped and signed by a Promálaga technician and you will be given the contact details of the consultancy.
  5. Obtain a registered copy of your presentation.
  6. An appointment will be made with the consultancy.
  7. In the event that the documentation submitted is incomplete, you will be required to correct it.

Telematic procedure: Open call for applications 2023

1. Start the procedure by sending a completed and digitally signed application and annexes to malagaemprende@promalaga.es attaching the scanned documentation. If you do not have a digital certificate, the forms must be completed and signed in person, for which an appointment must be made by calling +952 24 34 11 XNUMX.

2. The programme documentation will be reviewed and assessed by a Promálaga technician:

  • If the documentation is incomplete, we will contact the applicant to ask for it to be corrected.
  • If the documentation is correct, a Promálaga technician will contact the applicant to send them their free advice application validated by Promálaga, as well as the contact details of the assigned consultancy so that the service can begin.

4. DOCUMENTATION TO BE SUBMITTED

  1. Application form.
  2. Photocopy of the D.N.I/ N.I.E of the entrepreneur/s setting up the new company.
  3. Updated certificate from the SAE (Andalusian Employment Service) showing periods of unemployment registration or employment improvement card.
  4. Business plan, following the model available on the Promálaga website.
  5. Updated employment report of the jobs to be created.
  6. In the case of a legal entity, provide documentation accrediting the incorporation of the company or, if not, provide Annex 3: Company statutes template and negative certificate for the name.
  7. Annex 1: Declaration of responsibility.
  8. Annex 2: Consent for communications between Promálaga and the responsible consultancy.

5. DETAILS OF THE CONSULTANCY SERVICES

During the first year of trading this measure offers the company the services of a consultancy for the management of the following business areas:

Tax management and consultancy:

  • Processing of registration for tax and IAE (Tax on Economic Activities).
  • Study and advice on inclusion in the different tax regimes.
  • Settlement and presentation of an annual income tax return.
  • Settlement and presentation of corporate tax for a financial year.
  • Settlement of instalment payments, withholdings and VAT and submission of quarterly statements.

Accounts management and consultancy:

  • Preparation of accounts in accordance with the Code of Commerce and accounting standards.
  • Purchases and sales ledger (business); income and expenditure ledger (professional).
  • Capital assets ledger.
  • Reserve funds and advance payments ledger (professional).
  • Annual company accounts.
  • Process legalization of books in the Commercial Registry and in the Registry of Cooperatives.

Labour management and consultancy*

  • Affiliation, recruits, terminations, changes to data in the Social Security system, company registrations.
  • Drafting and preparation of all types of labour contracts, filing and registration in the Andalusian Employment Service.
  • Preparation of payroll and/or payslips, settlements, contribution summaries.
  • Drafting letters for sanctions, dismissals, disciplinary records, company certificates.
  • Dealing with Labour Inspections.

*The service of management of Social Security offered to the beneficiary covers a maximum of six workers, accumulated throughout the term of the year of free consultancy, and in any social security plan, as well as variations in the contract.

Information and guidance on incentives and subsidies:

The designated consultancy shall guide and support the entrepreneur in the processing and management of incentives, whose applications must be made directly by the entrepreneur. Those incentives which are the object of the consultancy must first be approved by Promálaga.
